Apply for or appeal against offsetting in future maintenance payments

If you’ve received a decision from NAV stating that you’ve paid too much maintenance, you can apply for an offset. This means that your monthly payments will be reduced.

We cannot pay out the money, but your monthly maintenance payment will be lower.

You can also submit an appeal against a decision on future maintenance payments.

Conditions for an offset:

  • NAV must have made a decision confirming that you’ve paid too much. 
  • The new maintenance payment must be higher than any advance payment to the maintenance recipient.
  • Your overpayment and the monthly maintenance payment must relate to the same child.
  • You must still have an ongoing maintenance payment to the child you’ve paid too much for. 
  • Only the maintenance payer can apply for an offset. 

If these conditions are not met, we cannot offset the payment. You must then yourself reclaim the amount from the maintenance recipient or collect it with the help of an enforcement officer.

The appeal must be in writing and contain the following:

  • what you’re appealing - for example, deductions, case processing, collection, or tax set-off. Companies and organisations can only request for money to be set aside for cost-of-living expenses if the company in question is a sole proprietorship.
  • an explanation of why you appeal
  • what your objective is with the appeal - for example, stopping deductions or offsets
  • signature (physical or electronic)
  • relevant documentation
