Joint and several liability
Joint and several liability means that more than one person is responsible for paying the same claim. All of them are responsible for the full amount until it has been paid.
If one person makes a payment towards the claim, the claim is reduced correspondingly for all who have the joint and several liability. If one person pays the full claim, the claim is considered paid for all who have joint and several liability.
Example:
Three people have joint and several liability, and the claim is NOK 21,000. If you pay NOK 7,000, the remaining claim will be NOK 14,000.However, all three of you, including yourself, will still be equally responsible for the remaining claim of NOK 14,000 – even if you've paid what you consider to be "your share".
Penalty for late filing of annual accounts
Initially, the business is responsible for paying penalties for late filing of its annual accounts. If the business does not pay, you will have a joint and several liability to pay the penalty if you're a member of the board, participant in the business, or general manager.
If the business is bankrupt or deleted, the penalty for late filing will not be deleted. If you have joint and several liability, you'll still be responsible for paying the claim.
Compensation claim
If several people have been sentenced to pay a compensation claim, they'll usually have joint and several liability.
