How much tax will you have to pay? - Sale of contract positions

A taxable gain will generally be considered capital income, which is taxed at the same rate as tax on general income of 22 percent. Losses will be deducted correspondingly.

However, in some cases gains may not constitute capital income. If you sell contract positions on a more systematic basis, you will be required to consider whether the gains constitute business income. Business income is taxed at a rate of up to 50.6 percent.

The most important criterion when considering whether gains constitute capital income or business income is the scope of the activity carried out when selling contract positions.

You can find the legislation in the guide Skatte-ABC (in Norwegian only), under item 3.3 “Virksomhet – allment” (Business activity – general).
